Welcome to Buzzed! These Terms of Service ("Terms") govern your access to and use of the Buzzed mobile application, website, and related services (collectively, the "Services") provided by Buzzed ("we," "our," "us," or "Company").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, downloading, installing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and/or through the application. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

2. Eligibility

3. Description of Services

Buzzed is a party trivia game application that provides:

  • ✓Multiple question categories for diverse gameplay experiences
  • ✓AI-generated trivia questions for premium users
  • ✓Pass-and-play and multiplayer functionality
  • ✓User account management and game statistics tracking

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.

4. User Accounts and Registration

To access certain features of our Services, you may need to create an account. When registering, you agree to:

You may register using email/password or through third-party authentication providers including Apple Sign In, Google Sign In, Facebook Login, and TikTok Login. When using third-party authentication, you authorize us to access and use certain information from your third-party account in accordance with our Privacy Policy.

5. Third-Party Authentication Services

Our Services integrate with third-party authentication providers to offer convenient sign-in options. By using these services, you agree to the following:

TikTok Integration

  • •When you authenticate via TikTok, we access your TikTok profile information (username, profile picture, display name) as authorized by TikTok's OAuth system
  • •We comply with TikTok's Developer Terms of Service and Platform Policies
  • •TikTok data is used solely for account authentication and profile display within Buzzed
  • •You may disconnect your TikTok account at any time through your account settings
  • •Your use of TikTok authentication is also subject to TikTok's own Terms of Service

Other Authentication Providers

Similar terms apply to authentication via Apple, Google, and Facebook. Each provider's data is handled in accordance with their respective terms and our Privacy Policy. We only access information necessary for account creation and authentication.

Data Usage: Information obtained through third-party authentication is used to create and manage your Buzzed account, personalize your experience, and provide customer support. We do not sell or share this data with third parties for their marketing purposes.

6. User Conduct

When using our Services, you agree NOT to:

  • •Violate any applicable laws, regulations, or third-party rights
  • •Use the Services for any illegal, harmful, or fraudulent purposes
  • •Attempt to gain unauthorized access to our systems or other users' accounts
  • •Interfere with or disrupt the integrity or performance of the Services
  • •Reverse engineer, decompile, or attempt to extract the source code of our software
  • •Use automated systems (bots, scrapers) to access the Services without permission
  • •Harass, abuse, or harm other users or any person
  • •Impersonate any person or entity or misrepresent your affiliation
  • •Encourage dangerous or irresponsible alcohol consumption

7. Intellectual Property Rights

Our Intellectual Property

The Services, including all content, features, functionality, software, text, graphics, logos, icons, images, audio clips, and data compilations, are owned by Buzzed or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use, subject to these Terms. This license does not include the right to:

  • •Modify, reproduce, or distribute the Services or any content
  • •Use the Services for commercial purposes without our written consent
  • •Remove any copyright, trademark, or proprietary notices

8. Subscriptions and Payments

Buzzed offers both free and premium subscription tiers. If you purchase a premium subscription:

  • ✓Billing: Subscriptions are billed through your app store account (Apple App Store or Google Play Store) on a recurring basis
  • ✓Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • ✓Cancellation: You can cancel your subscription at any time through your app store account settings
  • ✓Refunds: Refund requests are handled by Apple or Google according to their respective refund policies
  • ✓Price Changes: We reserve the right to change subscription prices with advance notice

All purchases are final and non-refundable except as required by applicable law or as explicitly stated in these Terms.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

We do not warrant that:

  • •The Services will be uninterrupted, secure, or error-free
  • •Any defects will be corrected
  • •The Services or servers are free of viruses or harmful components
  • •The results of using the Services will meet your requirements

Alcohol Disclaimer: Buzzed is a party game and does not promote or encourage excessive alcohol consumption. Please drink responsibly and in accordance with local laws. You are solely responsible for your decisions regarding alcohol consumption while using our Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUZZED, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • •Your access to or use of (or inability to access or use) the Services
  • •Any conduct or content of any third party on the Services
  • •Any content obtained from the Services
  • •Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Buzzed, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • •Your violation of these Terms
  • •Your use of the Services
  • •Your violation of any third-party rights or applicable laws
  • •Any content you submit, post, or transmit through the Services

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved through:

  2. 2.Mediation: If informal resolution fails, disputes may be submitted to mediation.
  3. 3.Legal Proceedings: If mediation is unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the courts of the Netherlands.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the intent of the original provision. All remaining provisions of these Terms shall continue in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and Buzzed concerning your use of the Services. These Terms supersede any prior agreements, communications, or understandings between you and us regarding the Services.

We reserve the right to modify these Terms at any time. When we make material changes, we will:
